It depends on your jurisdiction and on how the product is structured — a funded-trader programme evaluates traders on the firm's capital rather than taking client deposits, which is why it is usually treated differently from a brokerage. It is a question for a lawyer where you incorporate, and worth asking before you build rather than after. We supply the software, not the licence — and not the liquidity or the banking either: those are relationships you hold directly, and the platform connects to the provider you choose.
